TRESPASSING BETWEEN CLEATOR MOOR AND MOOR ROW. _____ Ben Porter MOSSOP, 30, wine and spirit merchant, High-street, Cleator Moor Jn. CARTNER, 37, joiner, 28, Scalegill-road, Moor Row Ed. RICHARDS, 42, Salvation Army Captain, Ennerdale Road, Cleator Moor Wm. BATSON, 60, General manager of Cleator Moor Co-operative Society, Crossfield Road, Cleator Moor Thos. TAYLOR, 38, Swainson Scalegill-road, Moor Row. Lizzie CARROLL, 21, married, Back Ginns Wm. CARROLL, 28, miner, Back Ginns Maggie ASHBURN, 27, married, 31, Back Row, Newhouses, all of Whitehaven. Annie Jane CARROLL, 22, married, 69, Trumpet Terrace, Cleator Chas. BOWELLS, 20,boiler,51, Main-street, Cleator Frank SOUTHWARD, 20, labourer, 21, North Street John DAVEY, 21, labourer 21, North-street John RYAN, 16, labourer, Back Wyndham-street, Cleator Moor Jos. GRUNDELL, 30, miner, 10 John-street, Moor Row Mary KELLY, 40, married, Bank End Cottages, Bigrigg Thos. BLACK, 20, miner, 70, Queen-street, Cleator Moor John STABLES, 27, labourer, 42, Bowthorn Road, Cleator Moor. Wm. JARDIN, 49, Joiner, Leconfield-street, Cleator Moor. Were all charged with having trespassed on the L. And N. W. And Furness Joint Railway, at or near Moor Row and between Moor Row and Cleator and Moor Row and Scalegill on various dates and times. Mr. ATTER prosecuted on behalf of the railway authorities. In the case of Wm. BATSON, Mr. CHAPMAN appeared, and said he submitted to the judgment of the Court, without defence. P. C.’s BARKER gave evidence in those cases. Mr. ATTER said the Railway Company feared if these things went on there would be some serious or fatal accidents. The constables had been specially engaged for this work. Jos. NICHOLSON employed by the Co. Said there were notices forbidding trespassing, and stating that persons trespassing were liable for a fine of 20s. BOWELLS and RYAN gave their wrong names and addresses. Mr. T. Gavan DUFFY gave evidence in support of GRUNDELL, whom he said was not wilfully trespassing, as he was going to witnesses’ house, which was the office of the Iron Ore Miners’ Association, of which the defendant was a member. The Clerk said the witness was not present, and the officer was present. Witness said he could not possibly go to his house without crossing the line. Mr. ATTER: Then you had better remove, and live somewhere else. Mr. DUFFY: I’ll come and lodge with you, Mr. ATTER, (laughter.) Mr. ATTER: Well, I would not mind. (Laughter.) The chairman said they could not make any exceptions in the case. All the defendants, except Mrs. KELLY were fined 10s each or seven days imprisonment; while she was ordered to pay the costs, 6s 6d, as her evidence supported her ignorance of the fact that she was trespassing. |
