PATRICK SMITH. ______ Patrick SMITH, a youth about fifteen years of age, was charged with having assaulted Bernard SANDALL, a Jew, who hawks small wares from market to market. Mr. ATTER appeared to defend. The complainant said that on Wednesday last the defendant had his tins displayed for sale next to him. The defendant shoved his tins on the complainant’s place and the complainant shoved them back, whereupon the defendant commenced to throw them at the complainant, who had to shield himself with his hand to prevent the tins from striking him. Defendant also took off his coat and offered to fight complainant. For the defence Mr. ATTER called a man named FLINT, who stated that the defendant did not throw his tins at the complainant, but that the complainant kicked the defendant’s tins. The Bench considered the case proved, and the defendant was fined 1s. And the costs, 14s. **** PATRICK SMITH FURTHER CHARGED. Patrick SMITH was further charged with having assaulted Alexander HINDLE, auctioneer, on Wednesday, in Workington Market Place. Complainant stated that on the day in question he saw the defendant assaulting SANDALL, and remonstrated with him. Defendant said, “If you say anything I will hit you.” He threw a tin at complainant and “ducked” him in the mouth with his head. Andrew HORNE, Sarah DOWE and Police-constable ARMSTRONG gave corroborative testimony. The Bench decided to fine the defendant 1s and the costs. |
