~~~~~~ WORKINGTON ______________ NON-PAYMENT OF RATES. - GEORGE KIRKWOOD was summoned at the instance of the Workington Local Board of Health, for non-payment of rates, amounting to £1 6s 2d. MR. PAISLEY appeared on behalf of the Local Board. It appeared that MR. KIRKWOOD had purchased the property, in respect of which the rates were claimed, from the Cockermouth Building Society, and it was contended, on behalf of the Local Board, that the defendant then became the owner of the property under the contract. MR. FAWCETT produced the rate-book to prove that the defendant's name appeared as owner. MR. PAISLEY said there was an action pending against MR. KIRKWOOD for the specific performance of a contract in connection with the property, and in consequence of MR. MILBURN being the solicitor for KIRKWOOD, he must object to his advising the Bench in the present case. MR. MILBURN said the present case had nothing whatever to do with the action against MR. KIRKWOOD for specific performance of the contract with the Building Society, therefore he would advise the Bench notwithstanding MR. PAISLEY's objection. He did not expect that any such insinuation would have been made by MR. PAISLEY. MR. PAISLEY said he had made no insinuation. The Defendant said the case was very simple. MR. PAISLEY knew that he had been prevented from receiving the rent of the property. The case was adjourned for a fortnight. _____________________________________ A VIOLENT EXCURSIONIST. - THOMAS DIXON, coalminer, the Ginns, Whitehaven, was brought up in custody on the charge of having on the 17th inst., assaulted RUSSEL USHER, railway guard, whilst in the performance of his duty. RUSSEL USHER stated that he was examining the tickets at Maryport Station on Monday evening, the 17th inst., when he found the defendant and his companion asleep in a carriage. On being awoke the prisoner sat up and struck him on the side of the face. A second charge of assault was preferred against the prisoner. POLICE-CONSTABLE CARRUTHERS stated that he was on duty at the Maryport Station on the 17th inst., when an excursion train arrived from Dumfries. The prisoner was given into custody, on the charge of having assaulted a guard, and being wild with drink he struck out right and left. The prisoner "skinned" his (witness's) hand with his teeth and kicked his ankles. Fined £1 for each offence, or one month's imprisonment with hard labour. _____________________________________ NON-PAYMENT OF RATES. - ROBERT GRISEWOOD, pawnbroker, Workington, was summoned at the instance of the Workington Local Board of Health, for non-payment of gas rates amounting to £1 17s 10-1/2d. MR. FIDLER appeared on behalf of the defendant, and pleaded that the charge was excessive. The case was adjourned for a week. ======================================================== |
