                DOE DEM. BRISCOE V. WATSON.

Mr. W. H. WATSON moved for the costs of the day on behalf of the defendant,
incurred by reason of the plaintiff not having proceeded to trial pursuant to
notice. The cause had been entered for trial at the last assizes for Carlisle,
and the defendant obtained a judge's order for the delivery of particulars of
breaches, coupled with a restriction from proceeding to trial if they were
refused. The plaintiff's attorney did refuse to furnish the particulars, and
consequently the case was not tried. Under this position of affairs, he, Mr.
WATSON, though instructed to apply for judgment as in case of nonsuit, would
abstain from so doing, and would confine his motion to a rule nisi for the costs
of the day. - Granted.
