LEAVE COTTAGE.

After 22 years as a chauffer-gardener, Thomas Leslie HAYTON found  it
increasingly difficult to live on his wage of £19 a month and found another  job. At
Workington County Court on Thursday he was ordered to give possession of  his
rent-free cottage to his former employer Mr. Ernest J. JOHNSTON, retired  
Midland Bank manager at Maryport, of Birkby Lodge, and pay him £11 for the 11  
weeks he has occupied the cottage since he resigned.

Mr. M. F. CAIN, for Mr. HAYTON, told Judge C. B. FENWICK his client  received
£4 weekly for the first three weeks of the month and £7 for the fourth.  When
he was refused an increase he obtained employment with the Workington Iron  
and Steel Company. He gave his notice to Mr. JOHNSTON and was told he would
have  to quit the cottage.

PROMISED HOUSE.

Defendant had tried to get a house in Birkby and had been told by  the
Cockermouth Rural District that he would get one within two  months.

Mr. HAYTON told his Honour that when he gave notice and was told to  quit the
cottage Mr. JOHNSTON did not suggest that there was any urgency about  the
matter. “I offered him rent but he waved his hand aside,” he  added.

He agreed with Mr. J. N. WORTHINGTON, for Mr. JOHNSTON for that the  owner
had been kept out of his cottage since November 2, when he terminated his  
employment.

His Honour said that no matter what discussions had taken place Mr.  HAYTON
had given up his employment and knew that his employer was entitled to  
possession of his cottage.

“He was given an inch and sought to take an ell,” he commented,  granting an
order for possession by March 14. Mr. HAYTON will pay rent of £1 per  week
until he vacates the premises.
